Terms of Service – Texas Five Star Paint & Body
About These Terms
1.1 Who we are. Texas Five Star Paint & Body is an auto body and paint repair facility located at 214 Range Dr, Garland, Texas. Phone: 469-583-7377. Website: texasfivestarpaintandbody.com.
1.2 Who these terms apply to. "Customer" or "you" means the owner of the vehicle, or anyone authorized to act for the owner (including a driver, family member, fleet manager, or insurance representative who drops off or approves work).
1.3 Acceptance. By requesting an estimate, leaving your vehicle with us, signing a repair authorization, or paying a deposit, you agree to these terms. If you do not agree, please do not authorize work.
1.4 Website use. Information on our website, including prices, photos, and timelines, is general and not a binding quote. Only a written estimate approved by Us and the customer binding.
1.5 Definitions. • Estimate: our written good-faith prediction of repair cost based on visible damage. • Supplement: additional work and cost found after repairs begin, such as hidden damage. • Total loss: a vehicle your insurer decides costs more to repair than it is worth. • OEM parts: new parts made by or for the vehicle manufacturer. Aftermarket parts: new parts made by other companies. Used/recycled parts: original parts taken from another vehicle.
Estimates, Authorization, and Repairs
2.1 Estimates are not final. An estimate is based on visible damage. Collision damage is often hidden behind panels, bumpers, and structure, so the final cost may differ. Estimates are valid for [30] days and may change if parts prices change.
2.2 Written authorization required. We begin work only after you (or your insurer, where you have authorized us to deal with them) approve the estimate or repair order. If you approve by phone, we will confirm the approval in writing, by text, or by email.
2.3 Supplements and hidden damage. If we find additional damage after teardown, we will contact you, or your insurer, with the added cost and time before doing that work. We will not exceed the authorized amount without your approval. If you cannot be reached, work on the affected area may pause, and delay is not our responsibility.
2.4 Repair standards. We repair vehicles following manufacturer repair procedures where available. This may include calibrating or resetting driver-assistance systems (ADAS), which can add cost and time. If you decline a recommended procedure, you accept the risk and we may ask you to sign a written waiver.
2.5 Parts. We may use OEM, aftermarket, or used/recycled parts, depending on what you and your insurer approve. We will identify the part type on your estimate or repair order. Parts supplied by you are installed at your risk, and we may not warranty the part or the labor to install it.
2.6 Removed parts. Replaced parts become our property unless you ask for them, except where the law or your insurer requires otherwise.
2.7 Sublet work. We may send some work (for example glass, wheel alignment, or specialty calibration) to qualified outside vendors. Their charges will be shown on your estimate or invoice.
2.8 Repair time. Any completion date is an estimate. Delays can come from parts availability, insurance approvals, hidden damage, weather, or supplier problems. We will keep you informed, but we are not liable for delays outside our control.
2.9 Color matching. Paint is matched using the manufacturer's color code and our professional equipment. Because paint on older vehicles fades and varies, a perfect match to the rest of the vehicle cannot be guaranteed. We may blend into adjacent panels for a better result, which will be shown on your estimate.
2.10 Pre-existing conditions. We are not responsible for dents, rust, scratches, mechanical problems, or other conditions that existed before you brought the vehicle in and are not part of the authorized repair. We document the vehicle's condition at drop-off with photos.
Payment, Insurance, and Storage
3.1 You are responsible for the bill. You are responsible for the full repair cost, whether or not insurance pays any part of it. Insurance coverage is a contract between you and your insurer, not us.
3.2 Deductibles and insurer payments. Your deductible and any amount your insurer does not cover are due when you pick up the vehicle. Insurance checks are often made out to you, or to you and the Shop; you agree to endorse and release the portion due to us. If your insurer pays us directly, we apply that payment to your balance.
3.3 Deposits. We may ask for a deposit of before ordering parts or starting work if the car is not at the shop. Special-order parts and materials already purchased for your job are non-refundable. Any remaining deposit is credited to your final bill.
3.4 Accepted payment. We accept cash, debit and credit cards, and cashier's check. 3.5 Payment at pickup. The balance is due in full when you pick up the vehicle. We may refuse to release the vehicle until it is paid, as described in Section 3.9.
3.6 Your right to choose a shop. You have the right to choose where your vehicle is repaired. Your insurer may recommend a shop, but it cannot require you to use one. If your insurer's estimate is lower than ours, we will work with them on a fair supplement, but you remain responsible for any difference they do not pay.
3.7 Diminished value and insurer disputes. We do not handle or guarantee diminished-value claims, rental-car coverage, or disputes with your insurer. We can provide repair documents, photos, and invoices to support your own claim.
3.8 Total loss. If your insurer declares your vehicle a total loss, your insurance will be paying for the storage and whichever work is done to that point, the customer doesn't need to pay
3.9 Repair lien. Under Texas law (Texas Property Code, Chapter 70), we may hold a lien on your vehicle for the unpaid cost of authorized repairs, and may keep the vehicle until you pay. If the bill remains unpaid, we may follow the notice and sale process the law allows.
3.10 Cancellation. You can cancel before work begins by notifying us in writing or by text or email. If work has begun, you owe us for work done and parts ordered up to that point, including teardown labor and any restocking fees.
Warranty, Liability, and Legal Terms
4.1 Workmanship warranty. We warrant our paint for 5years from the date you pick up the vehicle. If our workmanship fails, such as paint peeling, bubbling, or cracking, we will fix it at no charge. Keep your final invoice, since it is your proof of warranty but we do keep copies.
4.2 What the warranty does not cover. • Damage from a new accident, vandalism, hail, or other outside events • Stone chips, scratches, fading, or normal wear • Rust or corrosion unrelated to our repair • Parts we did not supply, and their manufacturers' defects (these follow the part maker's warranty) • Damage from automatic car washes in the first [30] days, or from harsh chemicals • Repairs altered or worked on by anyone other than us • Mechanical, electrical, or warning-light problems that existed before the repair
4.3 Paint care. New paint needs time to cure fully. For about [30] days, please avoid automatic car washes, waxing, and abrasive cleaners. Hand wash gently with mild soap.
4.4 Warranty claims. Contact us in writing, by phone or text, within [30] days of discovering the problem, and let us inspect the vehicle. The warranty is limited to repairing or redoing the defective work. It does not cover rental cars, lost time, or other indirect costs, to the extent the law allows.

4.8 Limit of liability. To the fullest extent Texas law allows, our total liability for any claim relating to our services is limited to the amount you paid us for the repair in question. We are not liable for indirect or consequential losses such as loss of use, lost income, or rental costs. Nothing in these terms limits rights you have under Texas consumer protection law that cannot legally be waived.
4.9 Photos and records. We take photos and video of your vehicle for documentation, insurance, and quality control. We may also share before-and-after photos of repairs for marketing, with license plates, VINs, and personal information removed. Tell us in writing if you do not want your vehicle shown.
4.10 Privacy. We collect your name, contact details, vehicle and insurance information to provide our services. We share them only with your insurer, parts suppliers, sublet vendors, and others needed to complete your repair, or as the law requires. We do not sell your personal information. By giving us your phone number, you agree that we may call or text you about your repair.
4.11 Resolving problems. If something is wrong, please talk to us first. Call 469-583-7377 and ask for a manager. We will work to make it right. If we cannot resolve it, either party may pursue the remedies the law allows.
4.12 Governing law and venue. These terms are governed by the laws of the State of Texas. Any lawsuit related to our services must be filed in the courts of Dallas County, Texas, unless the law requires otherwise. 4.13 If part of this is invalid. If a court finds any part of these terms unenforceable, the rest stays in effect.
4.14 Changes. We may update these terms. The version in effect when you sign your repair order applies to your repair.
4.15 Entire agreement. These terms, your estimate, and your signed repair order are the full agreement between us. If they conflict, the signed repair order controls.
